TRANSPOSITION THROUGH THE ROYAL DECREE- LAW 9/2017, OF 26 MAY, OF EC DIRECTIVES CONCERING FINANCIAL, CORPORATE, HEALTCHCARE AND THE POSTING OF WORKERS AREAS

Regarding the financial sector, Law 41/1999, of 12 November, on payment and securities settlement systems and the Stock Market law have been modified. In connection to Competition Law, there have been stablished damage liability. Moreover, it has been introduced into the Competence Defense Law related to damage claims caused by restrictive practices. Additionally, the Code of Civil Procedure introduces the regulation of the access of data sources in procedures of infringement claims in Competence Law. With regard to healthcare sector, there have been stablished quality and safety standards in respect of human tissues and cells. Finally, with reference to the posting of workers areas, Law 41/1999, of 12 November and Law for the Protection of Consumers and Users have been modified in order to introduce the method that has to be used by the employer when reimbursing the payment received from the consumer in case of cancellation.
